29 CFR  1910.95(c)(1):The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  Plant: On or about May, 17, 2023, an employee was exposed to an 8-hour time weighted average noise level of 89.1  dBA (equivalently a dose of 88.4%) in excess of the 85 dBA (equivalently a dose of 50%) while operating the meat grinding machine. A hearing conservation program was not fully implemented including monitoring, annual audiometric testing program, noise training, and the posting of the noise standard 1910.95.

29 CFR  1910.151(c):Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use:  Chemical Storage:  On or about May 17, 2023, there was no eyewash capable of providing 15 minutes of flushing, where LD 500 a corrosive cleaner was used in cleaning and sanitizing operations.

29 CFR  1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f) labeling, (g)Safety data Sheets, and (h) information and training  would be met:  Plant: On or about May 17, 2023, a written hazard communication program had not been developed and fully implemented where hazardous cleaning and sanitizing chemicals were used. Employer did not maintained a written hazard communication program with the required attached inventory list, ensure updated SDS were available to employees, and ensure all employees had received hazard communication information and training.
