29 CFR  1903.19(c)(1):The employer failed to certify to OSHA, within 10 calendar days after the abatement date, that cited violation had been abated:  (a) Trexx, LLC, failed to certify abatement within 10 calendar days after the abatement date that each of the following cited violations had been corrected:  Citation 1, Item 2 Serious violation of 29 CFR 1926.503(a)(1) with an abatement date of  September 9, 2024.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATIONS OF THE CORRECTIVE ACTION WORKSHEET).

29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502.   (a)  On or about May 8, 2024, at 1030 E. Minnesota Ave. Oak Creek, WI 53154, employees conducting roofing activities on a residential roof with a 6:12 pitch, were not protected from falling to the lower level. This exposed employees to a fall hazard of approximately 8 feet 8 inches on all sides of the residential home.

29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  (a) On or about May 8, 2024, at 1030 E. Minnesota Ave. Oak Creek, WI 53154, the employer did not ensure that employees exposed to potential fall hazards had been trained to recognize and minimize the fall hazards associated with their work.
